Terms of Use

Sendit (“Sendit,” “we,” “us”) provides hosted tools for musicians: smart links, artist pages, press kits, and a mailing-list / email broadcast feature, available at sendit.music. By creating an account or using the service, you agree to these Terms.

You must be at least 13 years old (or the age of digital consent where you live) to use Sendit, and old enough to form a binding contract. You're responsible for your account, for keeping access secure, and for everything done under it. Provide accurate information and keep it current.

You keep all ownership of the content you add — your music links, artwork, images, text, and the email addresses your fans give you (“Your Content”). You grant Sendit a non-exclusive, worldwide license to host, store, reproduce, and display Your Content solely to operate and provide the service to you and your audience.

You represent that you have the rights to everything you upload or link — including artwork, recordings, names, and trademarks — and that it doesn't infringe anyone's rights.

When you collect email addresses and send broadcasts through Sendit, you are the sender and are responsible for that mail. You agree to email only people who signed up to hear from you, to comply with anti-spam and privacy laws (including CAN-SPAM, CASL, and GDPR where applicable), and not to send unlawful, deceptive, or harassing content.

Sendit provides tools to help — double opt-in confirmation, a required one-click unsubscribe link, and suppression of unsubscribed addresses. We may rate-limit, suspend, or remove sending for spam complaints, high bounce rates, or abuse to protect deliverability for everyone.

Emails from Sendit.When you subscribe to an artist through Sendit, you may also occasionally receive email from Sendit itself (important service notices and the occasional product update). We keep these infrequent, and every one includes a one-click unsubscribe. Opting out of Sendit's own emails is separate from the artists you follow — unsubscribing from one doesn't unsubscribe you from the other.

You agree not to use Sendit to:

• post or distribute illegal, infringing, hateful, or sexually exploitative content; • impersonate others or misrepresent affiliation; • send spam or email people without consent; • upload malware or attempt to breach, scrape, or overload the service; • resell or white-label the service without permission; • use it to violate any law or third-party right.

Sendit links to and integrates with third-party platforms (e.g. Spotify, Apple Music, YouTube, and other stores, plus link-resolution providers). We don't control those services and aren't responsible for their content, availability, or terms. Your use of them is governed by their own agreements.

Sendit is currently free. We may introduce paid plans or features in the future and will give reasonable notice before charging you for anything you're currently using for free. We may modify or discontinue features over time.

The Sendit name, logo, software, and design are ours. These Terms don't grant you any right to use them except to use the service as intended.

You can stop using Sendit and delete your account at any time. We may suspend or terminate accounts that violate these Terms, create legal risk, or abuse the service. On termination, your public pages stop being served and your content may be deleted.

The service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We don't guarantee uninterrupted or error-free operation, or that links, imports, analytics, or email delivery will always be accurate or available.

To the fullest extent permitted by law, Sendit will not be liable for indirect, incidental, special, or consequential damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the prior 12 months or US $100.

You agree to indemnify and hold Sendit harmless from claims arising out of Your Content, your emails to your list, or your violation of these Terms or any law or third-party right.

These Terms are governed by the laws of the United States and the state in which Sendit operates, without regard to conflict-of-laws rules. We may update these Terms; material changes will be posted here with a new “last updated” date.
